Our Ms Chanéll Scheepers obtained her Masters Degree in Comparative Child Law with a comprehensive study of Family Law from the North West University, Potchefstroom and Justus-Liebig University, Germany. During same, she attended to an in debt research with regards to the Parental Rights and Responsibilities of Unmarried fathers in terms of Section 21 of the Children’s Act 38 of 2005. She now specialises in all Family Law related matters at Scheepers Pretorius Inc. and is big ambassador for Children’s Rights and enforcing same.

The Divorce Process

To begin the divorce process you need to have a summons served by the sheriff of the court. The divorce may be completed in either the Regional Court of the Magistrate Court having jurisdiction in your area or in the High Court. Two types of divorce currently exist, uncontested and contested divorce.

Division of Assets

The nature of your matrimonial property regime will determine how your assets will be divided in the unfortunate event of a divorce. There are two primary contracts, marriage in community of property and Marriage out of community of property. Both of which have stipulations on dividing assets.


Frequently during the divorce process and litigation thereof, a common issue that arises is whether assets held in a trust should be included or excluded when attempting to determine the estate of the parties involved during the divorce.
